T Visa Immigration Relief for Victims of Trafficking

What is a T Visa?

The T Visa is a form of immigration relief created for individuals who have been victims of human trafficking. It provides protection and a path to lawful immigration status for survivors of labor trafficking and sex trafficking.

Through the T Visa, survivors can remain in the United States, gain work authorization, access certain benefits and services, and eventually apply for lawful permanent residence (a green card). Importantly, the T Visa allows survivors to begin rebuilding their lives in safety, free from the control of traffickers.

Who Qualifies for a T Visa?

You may be eligible for a T Visa if you:

  • Are a victim of severe forms of human trafficking (labor or sex trafficking); we work primarily with victims of labor trafficking who have been taken advantage of by their employers
  • Are physically present in the U.S. on account of the trafficking
  • Have complied with any reasonable requests from law enforcement in investigating or prosecuting traffickers (unless under age 18 or unable to cooperate due to trauma)
  • Would suffer extreme hardship involving unusual and severe harm if removed from the U.S.

T Visa applicants may also include certain qualifying family members, ensuring that survivors can keep their loved ones safe and together.

Benefits of a T Visa

  • Four years of lawful status in the U.S.
  • Work authorization to support yourself and your family
  • Access to certain federal and state benefits designed for trafficking survivors
  • The ability to apply for a green card after three years (or sooner if a trafficking investigation is complete)
  • Eligibility to bring certain family members to the U.S.
