Do I Need a Photograph of Physical Abuse in a VAWA Application Packet?

If you’re applying for immigration relief under the Violence Against Women Act (VAWA), you do not need to include photographs of physical abuse for your case to be approved. While photos can be helpful, they are not required. USCIS reviews VAWA petitions based on "any credible evidence" of abuse.

This evidence can include personal statements, police reports, medical records, therapy notes, witness letters, and other documentation. VAWA cases often succeed without any photographic evidence, especially when the abuse is emotional, psychological, or financial rather than physical. The strongest piece of evidence is your affidavit/declaration describing the various forms of abuse.  In order to help our clients, our team will conduct an intake where we will ask detailed questions and draft the affidavit based on our conversation with the client.  Our clients will have then review and edit our written affidavit to ensure accuracy.

It’s important to know that VAWA protections apply to more than just physical violence. If your U.S. citizen or green card holder spouse or parent, controlled you, isolated you, threatened you, or emotionally manipulated you, you may qualify for VAWA protections and a green card. Parents of U.S. citizen children can also qualify for VAWA protections.
