Form Changes with No Grace Period Starting April 1, 2024

Starting April 1, 2024, a new fee rule will be in effect, impacting most immigration forms. Accordingly, some form editions will also be updated. It is crucial that all immigration applications use updated forms if filed on or after April 1, 2024. The updated forms include:

  • Form I-129, Petition for a Nonimmigrant Worker
  • Form I-129 CW, Petition for a CNMI-Only Nonimmigrant Transitional Worker
  • Form I-140, Immigrant Petition for Alien Workers
  • Form I-600, Petition to Classify Orphan as an Immediate Relative
  • Form I-600A, Application for Advance Processing of an Orphan Petition, and the form's supplements

While USCIS typically provides a grace period for new form editions, the changes introduced in the aforementioned forms correspond with fee increases and will not be given a grace period. Preview versions of each form are currently available on their respective webpages on the USCIS website.

USCIS Form I-140 with calendar

Beginning April 1, 2024, applicants and petitioners must submit the 04/01/24 edition of above-mentioned forms along with the appropriate fee listed on the USCIS Fee Schedule G-1055. USCIS will reject any submissions using prior versions of the forms. Please note that a rejected application can sometimes make you ineligible to file (i.e. if you have fallen out of status).Importantly, the 04/01/24 edition will only be accepted if postmarked on or after April 1, 2024.We encourage you to review the preview versions of the forms on the USCIS website.
