Is There a Deadline to File a VAWA Application?

A common question for individuals considering a Violence Against Women Act (VAWA) self-petition is whether there is a deadline to apply. In most cases, there is no general filing deadline for a VAWA self-petition (Form I-360). Eligible survivors of abuse by a U.S. citizen or lawful permanent resident spouse, parent, or child may file when they are ready, even if the abuse occurred years earlier.

That said, certain situations involve important timing rules. If you are filing as the abused spouse of a U.S. citizen or lawful permanent resident and the marriage has ended due to divorce or legal separation, the VAWA petition generally must be filed within two years of the termination of the marriage. Filing after this two-year period will result in ineligibility under VAWA.

Timing considerations can also apply to children. Generally, a child must be unmarried and under 21 to qualify, though VAWA allows limited flexibility for children to file up to age 25 if the abuse was a central reason for the delay. These rules do not function as strict deadlines for all cases but can affect eligibility depending on the facts.

While VAWA does not impose a universal deadline, filing sooner rather than later is often beneficial. Evidence such as affidavits, and witness statements may be easier to obtain closer in time to the abuse.
