Can a VAWA Application Be Expedited?

Many VAWA applicants face long wait times, often over 2 years for a decision on Form I-360. However, the current average processing time has increased significantly and now stands at approximately 41 to 42 months. While USCIS does not offer premium processing for VAWA cases, it is possible to request that your application be expedited. USCIS considers these requests on a case-by-case basis and will only approve them if certain criteria are met.

To qualify for expedited processing, it is necessary to show one or more of the following: severe financial loss, urgent humanitarian reasons, emergencies, a request from a nonprofit organization, or a government interest. For VAWA cases, USCIS may grant expedited review if there are safety concerns, medical issues, or urgent financial needs. Strong evidence, such as a doctor's letter, police report, or financial documentation, can help support your request.

We recently helped a client obtain a VAWA (Violence Against Women Act) approval in just five months—far faster than the current average processing time of 41 to 42 months. Our client is currently battling breast cancer, and the stress and uncertainty of her immigration status were negatively impacting her health. We submitted an expedite request with medical records and a letter from her physician explaining how the delay in her immigration case was affecting her treatment and well-being. USCIS approved the expedite request in just two months and, on the same day, approved her VAWA petition.

To request an expedite, you can contact USCIS through their customer service line at 800-375-5283 or through your USCIS online account. You’ll need to provide your receipt number and submit a written explanation with supporting documents. If you’re in removal proceedings, your attorney may also ask ICE to support your request, although that is less common.
