The H-1B Process for Employers

  1. Determine Eligibility – Confirm the position qualifies as a “specialty occupation” and the employee meets the education/experience requirements.
  2. Lottery Registration and Selection (if applicable) – For cap-subject petitions, applications must be registered and selected in the annual H-1B lottery which occurs once in March of each year.  Only selected registrants may submit a cap-subject H-1B petition.
  3. Labor Condition Application (LCA) – File with the U.S. Department of Labor to confirm wage and working condition requirements are met; prepare and maintain a public access file.
  4. H-1B Petition with USCIS – Submit Form I-129 and supporting evidence for the prospective employee
  5. Approval & Start of Employment – Once approved, the employee may begin working in H-1B status during the validity period specified on the approval notice

Employer Responsibilities

As an H-1B sponsor, employers must:

  • Pay the required prevailing wage
  • Ensure the employee works only in the position and location(s) listed in the petition or file an amendment
  • Maintain a public access file documenting compliance
  • Notify USCIS of any material changes in employment
